Political aspirant reveals why he clobbered Homa Bay MP in front of Raila Odinga

Homa Bay Parliamentary aspirant Washington Ogaga wrestled down area MP Peter Kaluma in a public brawl during the ODM rally. He says he has since recorded a statement even though Homa Bay County Police Commandant John Omusanga did not confirm any such statements being made with the police.

Ogaga said he was assaulted and he beat Kaluma in self-defense as Kaluma had ‘pushed him to the wall’ and he had been ‘on his neck,’ hurling unprintable insults since he declared interest in the Homa Bay seat.

“Kaluma has even called me a morgue attendant and a failure who should not be competing with him, yet I am a qualified Biomedical Engineer,” said Ogaga who was previously based in the UK.

The brawl happened after party officials left Waondo Village where they had attended a memorial service for the late Senator Otieno Kajwang and proceeded to the county stadium for a public rally.

Ogaga explains that it was at the stadium where all hell broke loose after his turn to speak saw his supporters surging forward with his portrait as Kaluma rallied his supporters as well.

“The MP then moved to me and told me to instruct my supporters to move back, but when I declined he started insulting me and threw a jab and a kick which I did not allow to land on me. Then I grabbed him and wrestled him down.”

Kaluma and Ogaga were separated by colleagues and security personnel prompting a fracas that lasted ten minutes.

But Kaluma now says he was protecting ‘Baba’ when he was attacked by ‘someone he never knew’, only to realise it was ‘Washington Ogaga, area parliamentary aspirant’ he has been reading about on social media.

Kaluma claims that Ogaga was part of a group hiring goons to boo ‘Baba’ during rallies and he had also opposed supporters carrying unwanted banners to the rally.

“I was not meant to be at the rally. My children were to be baptised on the same day, but I changed my mind at the last minute and begged the church to allow me postpone the baptism so that I could welcome ‘Baba’ in my constituency,” explained Kaluma, adding “as I stood on the podium to ask people to keep away any other banners, someone pounced on me from behind and threw me to the ground.”

It was at this point that he ‘acted in self-defense’ by kicking away the ‘strange man’, leading to fracas which saw security personnel firing in the air to disperse the surging crowd.

Kaluma promised he will not take legal action arguing that beating Ogaga at the ballot would be a fair game since “Up to now I do not have a competitor and I believe I will be re-elected Homa Bay MP unopposed. Those are just some of the challenges in politics, and I would not wish that the party disqualify him over his conduct, but leave him to compete so that I defeat him fairly.”

 Although Ogaga called for a truce ODM party has indicated it will take action. “We are doing our own investigations and will announce our actions after giving both of them right of reply,” said party chairman John Mbadi.

Narc Kenya party leader Martha Karua has dismissed reports that she would support President Uhuru Kenyatta’s re-election in the next year’s polls.

Speaking on Citizen TV’s Cheche Show on Wednesday, November 16, the former Gichugu MP said she did not declare her backing of any presidential candidate in the 2017 elections saying that her pronouncement less than a fortnight ago was a reflection of the stand of Narc Kenya, Kirinyaga Branch.

Karua said the perception that she would support President Kenyatta in 2017 is a misinterpretation of the media noting that, just like other Kenyans, her decision on who she will vote for is secret.

“We need to uphold the secrecy of the ballot as a means to build our democracy. Just like other Kenyans, my choice for the next elections is secret.”

“The reports about my support for Uhuru are just an interpretation of the media because my pronouncement in Kirinyaga was an echo of the decision by the county’s Narc Kenya branch to support Uhuru Kenyatta in the next election,” she said.

She said that her decision not to make public who she will support in the next elections is advised by her willingness to allow other Narc Kenya branches in the 30 counties that the party has presence to choose a candidate of their own.

“Many branches in the Mount Kenya area have said they will back Uhuru, and I respect their choice. But I still hold that each branch in the 30 counties that Narc Kenya has presence in should choose whoever they want to support in the presidential race.”

She remarked that, though Narc Kenya will not have a presidential candidate, it will not fold up and join any coalition.

“We need to allow our political parties to grow and as democracy matures, we will see fewer parties,” she said.

“We have made a decision that as we seek to grow as a party, we will not field a presidential candidate though we will have candidates in all other elective posts.”

This, and her open opposition for six-piece voting, she said, is advised by her willingness to give Kenyans freewill to choose whoever they want.

“I am totally opposed to six-piece voting because it makes people choose leaders who are less qualified to serve just because they belong to a certain party.”

Despite some of her party branches supporting President Uhuru Kenyatta, Ms Karua said she will still stand against perceived ills in Jubilee government and speak out against issues that affect Kenyans.

“Even when I was a Cabinet Minister in President Mwai Kibaki’s government, I spoke out against issues of national importance and that will not stop. This is important because if we don’t, people will not get the service they deserve.”

On her interest in Kirinyaga governorship seat, the former minister said she does not perceive her decision not to give another shot at the presidency as downgrading adding that she is motivate by the need to serve the people in a county-level.

“Being a governor is an opportunity to serve the people at the county level and ensure effective delivery of services to the people.”

“I am still consulting the people of Kirinyaga to come up with an inclusive manifesto though some of the key areas that I intend to focus on are health, infrastructure, agriculture, and education,” said the 2013 presidential candidate.

The Narc Kenya leader, who has been working closely with CORD leader Raila Odinga since after the last election, was said to have voiced her support for Uhuru in a bid to gain political goodwill from the Mr Kenyatta as she prepares for a grueling face-off with former Devolution Cabinet Secretary Anne Waiguru who will be vying on a Jubilee ticket for Kirinyaga seat.

While some Jubilee legislators welcomed her move, CORD members including Kakamega Senator Bonny Khalwale downplayed the significance of her “departure” saying she was not bringing any votes to CORD.

FIVE TO FIGHT IT OUT FOR ELECTORAL BODY'S TOP JOB IN KENYA

The race for the chairmanship of the electoral commission has narrowed down to three men and two women, all experienced lawyers.

Mr David Mukii Mereka, Ms Roseline Odhiambo-Odede, Dr John Kangu Mutakha, Ms Margaret Wambui Ngugi Shava and Mr David Malakwen Kiprop will now face the interviewing panel on November 28 and 29.

The panel has the delicate task of negotiating the tricky political and ethnic lines and balancing perceptions that would arise in its choice.

It is by law required to submit two names of the people it deems fit for the job to the President, who will select one for approval by Parliament.

As the returning officer for the presidential election, the chairman of the Independent Electoral and Boundaries Commission is an important figure.

Ten other applicants were declared unfit for the job, among them American Andrew Franklin, Justice Anyara Emukule and Mr Murshid Abdalla Mohammed, who is a member of the Police Service Commission.

In the long list of applicants published on Tuesday, Justice Emukule was listed as having failed to indicate his county of origin and not providing documents showing his qualifications.

The competition for the IEBC chairmanship will be among candidates from Murang’a, Kisumu, Kakamega, Kiambu and Nandi counties.

POLITICAL LEANING

In a country where associations are made based on one’s ethnic community and apparent political leaning, the panel’s choice of the two names is bound to be closely watched.

Mr Mereka, who will be the first to be interviewed, is from Murang’a County. His political affiliations are unknown but coming from a county neighbouring President Kenyatta’s Kiambu could be an issue.

He holds a masters degree in law from the University of Nairobi, where he also obtained his first degree.

The lawyer has worked as treasurer of the Football Kenya Elections Board.

Mr Mereka’s masters thesis is based on legislative and institutional issues that hamper environment cases.

He had also applied for the same job in 2009 after the team headed by Samuel Kivuitu was hounded out of office and the Interim Independent Electoral Commission set up.

CONSIDERED IDEAL CANDIDATE

Next on the interview list on November 28 is Ms Odede. The former vice-chairperson of the Judges and Magistrates Vetting Board is from Kisumu.

She could be considered an ideal candidate by the opposition and the ruling coalition on the basis of her origin as well as her background in LSK and the vetting board.

Ms Odede began her practice in 1993. In 2010, she became a council member of the LSK.

She was also a member of the Council of Legal Education and in September 2011, joined the vetting board. She describes herself as having an interest in family and child law as well as human rights, equity and equality.

Dr Mutakha Kangu will be interviewed at 3pm on the same Monday. The scholar chaired the task force that oversaw the development of laws to enable the implementation of devolution and is considered one of the foremost experts on Kenya’s Constitution.

However, his association with Cord leader Raila Odinga could cost or benefit him. Interviews on Tuesday will kick off with Ms Shava. She comes from Kiambu and was a member of the Truth Justice and Reconciliation Commission.

The last candidate to be interviewed will be Mr Kiprop. The University of Nairobi and Kenya School of Law-trained advocate has been Kenya Commercial Bank company secretary.

MCA files notice to impeach Governor Alfred Mutua

Some members of the Machakos County Assembly have filed a notice of motion to impeach Governor Alfred Mutua, three weeks after the plan was first announced.

The notice filed on Wednesday by Ndalani Ward Rep Stephen Muthuka accuses Dr Mutua of breaching the Constitution, procurement laws and the County Government Act.

Key among the issues in the notice is an alleged fictitious payment of Sh89 million for the de-silting of the Maruba Dam and the award of a contract to build an access road to a clearing and forwarding firm.

The notice indicates Dr Mutua and his leadership violated procurement laws when they awarded the contract to de-silt the dam in December 2015.

DANIDA FUNDS

“The works are purported to have been done in January and February 2016 but, during the period in question, Machakos County was experiencing El-Nino rains and the desilting could not have been done,” Mr Muthuka says in the notice.

Mr Muthuka claims the payment was made by the county government on a false certificate that was not backed by actual works on the ground.

The governor, he alleges, also presided over an irregular transfer of Sh161 million in DANIDA funds from the county government coffers to personal accounts.

The alleged use of county funds to mount signposts promoting Dr Mutua and his Maendeleo Chap Chap party is also another ground advanced for his ouster.

He is accused of launching projects funded by county funds and branding them as if they were Maendeleo Chap Chap programmes.

BANK LOANS

The MCA also accuses the county boss of irregular borrowing from banks without authorization of the county assembly and failure to channel all revenue to the official bank accounts.

“The governor and the county government has set and maintained an M-Pesa line and paybill number 656500 to which money was and continues to be paid," he claims

"However, the same is not deposited into the county government accounts and is instead withdrawn and consumed at source, contrary to provisions of the County government Act."

Other reasons given for Dr Mutua's removal include alleged mismanagement of Sh600 million in the department of transport, roads and public works and irregular purchase of vehicles by the county government.

AMBULANCES

“The governor and the county government procured 70 ambulances, amounting to Sh145 million, and 140 TIDA Saloon vehicles, amounting to Sh219 million, without following the Public Procurement and Disposal Act,” Mr Muthuka charges.

Seven county government officials are battling the allegations in court.

County Assembly Speaker Bernard Mung’ata said proper procedure had been followed and that the governor has seven days to respond to the allegations listed in the notice.

Dr Mutua has been accusing the MCAs of "blackmail" and demanding money in order to drop the impeachment motion.
